Acceptable Use Policy

Use ExitNode lawfully, with accounts, identities, payment methods and data you are entitled to use, and in a way that respects the rights of others. You are responsible for your own conduct and for the conduct of anyone who uses the Services through your account or Org.

You may not use the Services, the Software or any Third-Party Service connected through them to:

• violate any applicable law or regulation, or help anyone else do so;
• commit or facilitate fraud, including payment fraud, chargeback or refund fraud, promotion or coupon abuse that violates the law, card testing, or using any payment card, bank account or other payment method you are not authorized to use;
• commit or facilitate identity theft, or impersonate a real person or organization, or use another person's personal information, without their authorization;
• access any account, system or data without authorization, including by credential stuffing, account takeover or exceeding the access you have been granted;
• purchase event tickets in violation of the Better Online Ticket Sales Act (15 U.S.C. § 45c), California Business and Professions Code § 22502.1, or similar laws;
• create, post or procure fake, incentivized or misleading reviews, endorsements, ratings, followers or engagement, including in violation of the FTC's rule on consumer reviews and testimonials (16 C.F.R. Part 465);
• send spam or unsolicited messages, or send messages in violation of the CAN-SPAM Act, the Telephone Consumer Protection Act or similar laws, including through phone numbers obtained through the Services;
• distribute malware, run phishing campaigns, or engage in any other activity that could damage, disable or impair any device, network or service;
• harass, threaten, defame or stalk anyone, or infringe or misappropriate anyone's intellectual property, privacy or publicity rights;
• collect, store or process personal information in violation of applicable privacy or data protection laws;
• manipulate markets, elections or public discourse, or engage in coordinated inauthentic behavior intended to deceive the public;
• store, share or facilitate child sexual abuse material or any content that exploits minors;
• evade sanctions or export controls, or provide access to the Services to any prohibited person or place.

You may not:

• do anything prohibited by Section 5 of the Terms (reverse engineering, tampering and misuse of the Software);
• probe, scan or test the vulnerability of our systems, or breach or circumvent any security or authentication measure, except with our prior written permission (send security reports to legal@exitnode.app);
• interfere with or overload our systems, including by sending excessive requests or using the Services in a way that degrades them for others;
• use the Services to create or manage ExitNode accounts in bulk, or to evade a suspension, termination, plan limit or device limit;
• share login credentials, or allow anyone who is not an authorized member of your Org to use your account;
• use temporary phone numbers, catch-all inboxes or Credits in a way designed to obtain refunds or benefits you are not entitled to.

You are responsible for knowing and complying with the terms and policies of every Third-Party Site you access and every Third-Party Service you connect, including any limits they place on automated access, multiple accounts or purchases. We do not review or approve how you use the Services on any Third-Party Site.

If you enable live monitoring or review the activity of members of your Org, you must do so lawfully, including by giving any notice and obtaining any consent the law requires, and only for legitimate purposes related to your Org's use of the Services.

We may investigate suspected violations of this Policy and cooperate with law enforcement. If we believe you have violated this Policy, we may take any action we consider appropriate, including warning you, removing content, limiting features, or suspending or terminating your account and any related accounts as described in the Terms, which may result in forfeiture of fees and Credits as the Terms provide.

We may update this Policy as described in Section 16 of the Terms.
